คำชี้แจง กรณีสื่อกัมพูชาอ้างความเห็นนักวิเคราะห์วิจารณ์ท่าทีไทยต่อสหประชาชาติ

ศูนย์ข่าวสารสถานการณ์ ไทย – กัมพูชา (JIC) ขอชี้แจงกรณีสื่อกัมพูชานำเสนอความเห็นของนักวิเคราะห์ที่กล่าวหาว่าประเทศไทย “ไม่ให้ความสำคัญกับองค์การสหประชาชาติ (UN)” สืบเนื่องจากการที่รัฐบาลไทยแสดงข้อกังวลต่อถ้อยแถลงของผู้เสนอรายงานพิเศษ
แห่งสหประชาชาติว่าด้วยสถานการณ์สิทธิมนุษยชนในกัมพูชา (Special Rapporteur) โดยขอเรียนชี้แจงข้อเท็จจริง ดังนี้

1. ไทยเคารพกลไกสหประชาชาติ แต่ยึดมั่นในความถูกต้องและรอบด้าน – ประเทศไทยให้ความสำคัญและให้ความร่วมมือกับ ผู้เสนอรายงานพิเศษด้านสิทธิมนุษยชนมาโดยตลอด โดยปัจจุบันไทยเป็นประเทศสมาชิกของคณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ (HRC) ด้วย การทักท้วงถ้อยแถลงของผู้เสนอรายงานพิเศษฯ ในส่วนที่อ้างอิงประเทศไทย เป็นการดำเนินการตามหลักการ เนื่องจากการอ้างอิงดังกล่าวเป็นการดำเนินการนอกเหนือขอบเขตหน้าที่ มีข้อมูลที่บิดเบือน และไม่มีการตรวจสอบอย่างรอบด้าน การตั้งข้อสังเกต
   เพื่อความถูกต้องจึงเป็นสิทธิอันชอบธรรม
2. กระบวนการจัดทำรายงานขาดความเป็นมืออาชีพและไม่เป็นกลาง – วิธีการทำงานของผู้เสนอรายงานพิเศษฯ สะท้อนความไม่เป็นมืออาชีพ ไม่เป็นกลาง และไม่ให้เกียรติประเทศไทยในฐานะประเทศที่ถูกพาดพิง ผู้เสนอรายงานพิเศษฯ ไม่ได้เปิดโอกาสให้ไทย
   ในการนำเสนอข้อเท็จจริงก่อนการเผยแพร่แถลงการณ์ รวมถึงไม่ได้นำข้อมูลที่ผู้แทนถาวรไทยประจำสำนักงานสหประชาชาติ ณ นครเจนีวา ได้ชี้แจงไปก่อนหน้านี้มาประกอบการพิจารณา โดยเฉพาะประเด็นข้อเท็จจริงที่สำคัญว่าประเทศไทยไม่ได้เป็นผู้เริ่มต้นความขัดแย้ง
   แต่เป็นฝ่ายกัมพูชาเองที่เป็นผู้เริ่มก่อให้เกิดสถานการณ์ความขัดแย้งนี้ขึ้น ซึ่งการทำงานในลักษณะนี้ย่อมสามารถถูกนำมาใช้เป็นเครื่องมือเพื่อผลประโยชน์ทางการเมืองได้
3. ตัวเลขผู้พลัดถิ่นต้องโปร่งใสและตรวจสอบได้ – กรณีการอ้างอิงสถิติผู้พลัดถิ่นภายในประเทศ จำนวน 650,000 คน นั้น ข้อเท็จจริงปรากฏว่า กลุ่มบุคคลส่วนหนึ่งตามที่อ้างถึงคือชาวกัมพูชาที่เข้ามาอาศัยในอดีตพื้นที่พักพิงชั่วคราวที่ไทยเคยเปิดให้ความช่วยเหลือด้านมนุษยธรรมตั้งแต่ช่วงปลายคริสต์ทศวรรษ 1970 จึงถือเป็นกลุ่มบุคคลที่รุกล้ำเข้ามาในเขตแดนไทย และไม่เข้านิยามของการเป็นผู้พลัดถิ่นภายในประเทศแต่อย่างใด
4. ความเห็นของนักวิเคราะห์ ไม่ใช่ข้อสรุปของสหประชาชาติ – ข้อกล่าวหาที่ปรากฏในสื่อเป็นเพียงความคิดเห็นของบุคคล ที่สื่อกัมพูชาเลือกนำมาอ้างอิง มิใช่ข้อมติหรือข้อสรุปของคณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ การนำเสนอข้อมูลฝ่ายเดียว
   โดยปราศจากการตรวจสอบข้อเท็จจริง ไม่ควรถูกนำมาสร้างความเข้าใจผิดต่อประชาคมระหว่างประเทศ ทั้งนี้ แถลงการณ์ของผู้เสนอรายงานพิเศษฯ ดังกล่าวไม่ใช่แถลงการณ์ทางการขององค์การสหประชาชาติ (UN)
5. การตรวจสอบข้อเท็จจริงต้องเป็นกลางและครอบคลุมทั้งสองฝ่าย – ผู้เสนอรายงานพิเศษฯ ไม่ได้คำนึงถึงข้อเท็จจริงและมุมมองจากทุกฝ่ายที่เกี่ยวข้องอย่างรอบด้านและครอบคลุม โดยละเลยผลกระทบที่เกิดขึ้นกับพลเรือนไทยที่ต้องเสียชีวิต ได้รับบาดเจ็บ
   และต้องอพยพออกจากบ้านเรือนจากเหตุการณ์ความขัดแย้งเช่นเดียวกัน สถิติตัวเลขและข้อกล่าวหาเรื่องการล่วงล้ำเขตแดนจำเป็นต้อง ได้รับการตรวจสอบอย่างโปร่งใส เป็นกลาง และอิงหลักฐานที่ได้รับการตรวจสอบ ไม่ใช่อาศัยเพียงข้อกล่าวหาฝ่ายเดียว
   การดำรงตำแหน่งที่ได้รับการแต่งตั้งจากสหประชาชาติ ไม่ใช่แค่การปฏิบัติงานตามหน้าที่ แต่ต้องแสดงให้เห็นถึงความเคารพ ต่อหลักความเป็นกลางและมีความรับผิดชอบในการปฏิบัติหน้าที่ ซึ่งเป็นเครื่องพิสูจน์ความน่าเชื่อถือในเวทีสากล

Clarification regarding Cambodian Media Citing Analysts’ Opinions criticizing Thailand’s Stance toward the United Nations.

The Joint Information Center on the Thailand-Cambodia Situation (JIC) wishes to clarify the facts regarding reports by Cambodian media citing analysts’ opinions accusing Thailand of ‘failing to attach importance to the United Nations (UN).’ This follows the Thai government’s expression of concern over the statement made by the UN Special Rapporteur on the situation of human rights in Cambodia. The JIC would like to clarify the facts, as follows:

1. Respect for UN Mechanisms, while Committed to Accuracy and Comprehensive Information – Thailand has consistently attached importance to and cooperated with the Special Rapporteur on human rights. Currently, Thailand is also a member of the UN Human Rights Council (HRC). Thailand’s objection to the Special Rapporteur’s recent statement where it references Thailand is a matter of principle, as the reference exceeded his mandate, contained distorted information, and lacked comprehensive verification. Raising observations for the sake of accuracy is not only legitimate but should be welcomed.
2. Lack of Professionalism and Impartiality in the Reporting Process – The working methods of the Special Rapporteur reflect a lack professionalism, impartiality and respect for Thailand as a referenced country. The Special Rapporteur did not afford Thailand an opportunity to present the facts prior to the release of the statement, nor did he incorporate related information previously clarified by the Permanent Representative of Thailand to the UN in Geneva. Critically, the statement omitted the fundamental fact that
   it was not Thailand, but Cambodia that initiated the clashes. Such working methods risk being exploited for political gain.
3. Figures related to Internally Displaced Persons (IDPs) must be Transparent and Verifiable – Regarding the reference to 650,000 IDPs, the facts reveal that a portion of the referenced group comprises Cambodians who had resided in former temporary shelters that Thailand opened up to provide humanitarian assistance since the late 1970s. They were individuals who encroached upon Thai territory and do not fall under the definition of IDPs.
4. Analysts’ Opinions Do Not Constitute UN Conclusions – The allegations appearing in the media are solely the opinions of individuals selectively cited by the Cambodian media. they are not resolutions or conclusions of the UN Human Rights Council. The presentation of one-sided, unverified information contained in the statement by the Special Rapporteur should also not be used to mislead the international community and is not an official statement of the United Nations.
6. Fact-Finding Must be Impartial and Comprehensive for Both Sides – The Special Rapporteur failed to take into account the facts and perspectives of all relevant parties in a comprehensive manner. He notably neglected the impact the clashes have had on Thai civilians who have suffered loss of life, injuries and forced displacement from their homes as well. Statistics and allegations regarding territorial incursions require transparent and impartial verification based on verified evidence, rather than relying solely on unilateral claims.

Serving a position under appointment by the United Nations is not merely about fulfilling one’s duties, but also about demonstrating respect for the principles of neutrality and accountability in the performance

of those duties, which is a testament to credibility on the international stage.
